If you employ more than 50 people in your company, you are obliged under the Whistleblower Protection Act (HinSchG) to set up a reporting office in accordance with the legal requirements.
The reporting office must protect the confidentiality of the whistleblower’s identity, and it must be possible to submit reports anonymously. The reporting office must also be accessible to all employees and relevant external persons.

Hanging up a „grievance box“ is not enough. Failure to set up secure internal reporting channels constitutes an administrative offense, as does the violation of confidentiality by the employees of the reporting office itself, or the obstruction of communication between the reporting person and the reporting office.
The employees of the reporting office should therefore be able to determine whether the report is a case of application of the HinSchG and to clarify the reported facts within a company.
This obligation to set up a whistleblower protection system is also regulated in other laws, for example:

Insurance Supervision Act (VAG)

Insurance companies are required by the VAG to set up an internal whistleblower system in order to report, among other things, violations of supervisory regulations as well as criminal offenses. The VAG contains additional reasons for notification.

Money Laundering Act (GwG)

For obliged entities under the AMLA, the need to set up a whistleblower system is an internal security measure for reporting suspected cases of money laundering and terrorist financing.

General Equal Treatment Act (AGG)

The AGG also stipulates that companies must take measures to prevent discrimination in the workplace, including the establishment of a reporting office.

Supply Chain Due Diligence Act (LkSG)

Large companies that have to comply with the obligations under the LkSG must operate a complaints office, which can also be identical to the whistleblower system, in order to be made aware of violations of human rights and environmental due diligence obligations in their supply chains.

Corporate Sustainability Due Diligence Directive (CSDDD)

The EU’s draft law on the protection of human rights and the environment, which will lead to amendments to the LkSG once it comes into force, also includes the obligation to set up a whistleblower system.
